PCG reveals IR35-friendly contracts

The Inland Revenue has approved the first non-IR35 contract based on a contract produced by the Professional Contractors Group (PCG), a group that represents over 6,000 contractors. A PCG member gave his personalised 'contractor to agent' PCG contract to the Revenue for vetting and it was approved as IR35-friendly.

Provided the contract serves as an accurate reflection of the contractor's working status, the Revenue concluded that the contract 'would not be subject' to the proposed IR35 legislation.

The contract, drafted by the PCG solicitors Bevan Ashford, is available free of charge to PCG members from its website. A number of contract 'templates' to suit different circumstances are provided.

Chairman of the PCG, Gareth William said, "This is a major breakthrough for contractors and for the standing of PCG's contract. As far as we are aware, this is the first time the Revenue has brought some degree of certainty to a contract."
