SAP is asking a US court to force Oracle to reveal its profit
margins on JD Edwards and PeopleSoft software and support
contracts.
The SAP call is linked to the
legal action Oracle brought in 2007 against its rival, after it
was revealed that staff of a SAP maintenance support subsidiary had
wrongly downloaded Oracle support software from Oracle systems.
It is alleged by Oracle this software was used by SAP to try to
poach its customers.
Both companies want to settle the dispute, but SAP's call for
profit margin figures on specific Oracle products has been rejected
by Oracle.
Such information is regarded as highly confidential by most
software companies. If it became public, it would put them at a
disadvantage when negotiating new deals with customers and would be
useful to rivals.
SAP claims the information is necessary to estimate out of court
damages to Oracle.
