Thank you to Dr Neil Bhatia who suggested the questions I put to NHS Connecting for Health.
He has further questions:
"What happens if a patient presents to A&E and is asked if their SCR [summary care record] can be viewed, and they refuse? That may be the first time that they realise that they even have a SCR.
"Is that a situation where their SCR "should have been accessed" and have they then forfeited their right to get their data deleted on discovering that they had their data uploaded?"
"The devil will be in the detail and it [the right of a patient to delete their summary care record] might yet turn into smoke and mirrors."
